Welcome to MyPokéSpace. These Terms & Conditions (the “Terms”) govern your access to and use of MyPokéSpace at https://mypoke.space (the “Service”). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. About MyPokéSpace

MyPokéSpace is a free, invite-only fan site for Pokémon trainers to build a public profile, track decks and tournament results, and connect with friends. It is a community project; access is at our discretion.

2. Not affiliated with Nintendo or The Pokémon Company

MyPokéSpace is an unofficial fan project. We are not affiliated with, endorsed by, or sponsored by Nintendo, Game Freak, Creatures Inc., The Pokémon Company, The Pokémon Company International (TPCi), or any of their affiliates. “Pokémon”, Pokémon character names, sprites, artwork, and all related trademarks and copyrights are the property of their respective owners. Their use on MyPokéSpace is for identification and informational purposes only.

If you are a rights holder and believe content on the Service infringes your rights, please contact us at emma@mypoke.space and we will respond promptly.

3. Eligibility

You must be at least 13 years old to use the Service. If you are between 13 and the age of majority where you live, you may use the Service only with the involvement of a parent or guardian. The Service is invite-only; you need a valid invite code to create an account.

4. Your account

You are responsible for keeping your login credentials secure and for all activity that occurs under your account.
You must provide accurate information when you sign up, and keep it accurate.
You may not share, sell, or transfer your account, your handle, or your invite codes for value.
One person per account; do not impersonate another trainer or person.

5. Acceptable use

You agree not to use the Service to:

Post content that is illegal, harassing, hateful, threatening, sexually explicit, or that targets or endangers minors.
Dox, stalk, or otherwise expose other people’s private information.
Spam, run automated scraping or load attacks, or attempt to bypass authentication, rate limits, row-level security, or moderation.
Upload content you do not have the rights to share, or content that infringes the intellectual property of others.
Use the Service to advertise commercial products or run paid promotions without our prior written permission.
Reverse-engineer, decompile, or attempt to extract source code, except to the extent that applicable law expressly permits despite this limitation.

6. User content

You retain ownership of the content you post to the Service (your handle, blurb, Top 8 picks, decklists, tournament notes, uploads, etc. — “Your Content”). By posting Your Content you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for formatting and moderation), display, and distribute Your Content solely as needed to operate, promote, and improve the Service. This license ends when you delete Your Content from the Service, except to the extent we are required to retain it (e.g. in backups, or in de-identified form for safety or analytics).

You represent that Your Content does not infringe the rights of any third party and complies with these Terms. We are not responsible for Your Content or for content posted by other users.

7. Imported content

The Service lets you import decklists, team exports, and game logs from third-party formats (e.g. PokePaste, PTCG Live exports). You are responsible for ensuring you have the right to import any such content. We do not endorse and are not responsible for third-party sites or formats.

8. Moderation, suspension, and termination

We may review, remove, or hide content; suspend or terminate accounts; and refuse access to the Service, in each case in our discretion, including for violations of these Terms or to comply with the law. Suspended accounts lose access to the editor and may have their profile hidden. You can stop using the Service at any time; contact us to permanently delete your account.

9. Fees

The Service is currently free. Any reference inside the app to a paid “Pro” tier (for example, an error message claiming a feature requires Pro) is a fan-site joke; no paid product exists and no charges will be made. If we introduce paid features in the future, we will update these Terms first.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY CONTENT (INCLUDING YOUR OWN) WILL BE PRESERVED WITHOUT LOSS. YOU USE THE SERVICE AT YOUR OWN RISK.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL MYPOKÉSPACE OR ITS OPERATORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR REVENUE, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED USD $50.

12. Indemnification

You agree to defend, indemnify, and hold harmless MyPokéSpace and its operators from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of (a) Your Content, (b) your use of the Service, or (c) your violation of these Terms.

13. Changes to the Service or these Terms

We may change, suspend, or discontinue any part of the Service at any time. We may also update these Terms; when we do, we will update the “Last updated” date above and, for material changes, notify you in-app or by email. Continued use of the Service after changes take effect means you accept the revised Terms.

14. Governing law

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws principles, and you agree to the exclusive jurisdiction of the state and federal courts located in San Francisco County, California for any dispute arising out of these Terms or the Service, except where prohibited by applicable law.
